Terms of Service

These terms of service, together with any other agreements or terms incorporated by reference, including the Privacy Policy available at https://www.aibooki.com/privacy-policy (the “Terms”) govern your use of the Services. These Terms constitute a binding and enforceable legal contract between Company and You. By accepting these Terms electronically by clicking a box indicating your acceptance, or by using the Services, you agree to these Terms. If you are entering into these Terms on behalf of a company or another legal entity, you represent that you have the authority to bind such entity and its affiliates to these Terms, in which case the term “You” will refer to such entity and its affiliates. If the legal entity that you represent does not agree with these Terms, you must not accept these Terms or use the Services.

1. Definitions

  • "Content" means any files, data, material and information submitted, uploaded and stored by You through the Service, including but not limited to children's photos.
  • "Platform" means Company's online solution for creating personalized AI-written and illustrated books for children.
  • "Services" means any applications, products, services, documentation, and software made available through the Platform.
  • "We", "Us", "Company" or "Our" means aibooki.com.
  • "You" or "Customer" means the individual, company or other legal entity and its affiliates for which you are accepting these Terms.

2. The Services

We may update the Services from time to time, including adding or removing functions. Some features of the Platform may utilize artificial intelligence (“the AI Features”). You are solely responsible for the legality, accuracy, and quality of any data you provide (“Input”), including ensuring that your collection and use of such data comply with all applicable laws and privacy policies. You acknowledge that any output generated by the AI Features (“Output”) is dependent on the Input provided and may not be unique.

3. Your Content and Data Privacy

License to Content: You grant us a worldwide, non-exclusive license to host, copy and use your Content as required to provide you with the Services. We do not acquire any right in your Content, and you or your licensors retain all rights and ownership.

Responsibility for Content: You are responsible for your Content. The Services are not intended for storage or archiving. It is your responsibility to back up your Content.

Handling of Children's Photos: We are committed to protecting the privacy of our youngest users. When you upload a child's photo to create a book, that photo is used exclusively for the purpose of generating the illustrations for your book. The process is secured using industry-standard measures. The photo is retained for a limited period to allow you to edit your book or order additional copies, after which it is permanently deleted from our systems. We do not store, share, or use these photos for any other purpose.

4. Fees and Payment

You will pay all fees with respect to the Services. Fees are non-refundable except as outlined in our Return Policy available at https://www.aibooki.com/return-policy. You are responsible for providing complete and accurate billing information. Our fees do not include taxes.

5. Use Obligations and Restrictions

You agree to comply with all applicable laws and use reasonable security precautions. You must not misuse the Services, including but not limited to selling or leasing the Services, circumventing access restrictions, or using the Services for unlawful purposes.

6. Intellectual Property Rights

We and our licensors reserve all rights, title, and interest to the Services and the Platform. To the extent you provide us any feedback, you grant us a royalty-free, worldwide, perpetual license to incorporate the feedback into our Services.

7. Indemnification

You will indemnify, defend, and hold harmless Company and its affiliates from and against all liabilities, damages, and costs arising out of any claim by a third party alleging that your Content or your use of the Services infringes a third party’s rights or violates applicable law.

8. Disclaimers and Limitation of Liability

THE SERVICES ARE PROVIDED “AS IS”. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF DEFECTS. IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE GREATER OF US$100.00 OR THE FEES PAID BY YOU FOR THE SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Term and Termination

These Terms commence when you first accept them and remain in effect until your subscription expires or is terminated. We may suspend or terminate your access at any time if you do not comply with these Terms.

10. General

Governing Law: These Terms are governed by the laws of the state of Israel. Changes to Terms: We may change the Terms from time to time, and such changes will become effective upon being posted on our website. Shipping and Delivery: We use external providers for manufacturing and shipping. Delivery times may vary, and we are not responsible for shipping delays.
